VParking.ca Terms and Conditions

  • Acceptance of Terms: By checking the box to accept these terms on VParking.ca and using our website or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.
  • User Responsibility:
    • You are responsible for providing accurate, current, and complete information when using our services (including license plate details, contact information, and any other required data).
    • You agree not to misuse VParking.ca for any unlawful activities or in any way that violates these Terms and Conditions.
    • Any consequences arising from false information or misuse of the platform are solely your responsibility.
  • Liabilities and Disclaimers:
    • VParking.ca provides a platform for license plate registration and parking management on an "as is" basis. We make no guarantees regarding the availability, accuracy, completeness, or reliability of our services.
    • To the fullest extent permitted by law, VParking.ca disclaims all liability for any loss, damage, or inconvenience arising from the use of our services. This includes, but is not limited to, situations such as parking fines, towing of vehicles, or other consequences even if such events occur after using our service.
    • We are not responsible for errors or inaccuracies in information provided by users.
    • While we may facilitate sharing of your information with third parties (per our Privacy Policy), we assume no liability for any actions or outcomes arising from third-party use of your data beyond the purposes outlined.
  • Limitation of Liability and Reimbursement:
    • In the event VParking.ca is found to be at fault due to an error or issue in our services, our liability is limited. At our sole discretion and on a case-by-case basis, we may offer reimbursement up to a maximum of $500 CAD.
    • This potential reimbursement is not guaranteed and will only be determined in exceptional circumstances where our direct action or inaction is proven to have caused a verifiable loss.
    • Under no circumstances will VParking.ca be liable for amounts exceeding this limit.
  • User Confirmation of Information:
    • After registering your license plate or other details, you will receive a confirmation of registration (such as a confirmation message or email).
    • It is your responsibility to review this confirmation and ensure all information is correct.
    • If you discover any errors or inaccuracies in the information you provided, you must promptly notify VParking.ca (for example, by contacting us at info@vparking.ca) so that corrections can be made.
    • VParking.ca is not responsible for verifying the accuracy of user-provided information, and we will only be aware of any errors if and when you or an affected party alerts us to them.
  • Confirmation and Vehicle Towing:
    • Successful registration of your license plate should result in a confirmation (e.g., a reference number or confirmation email).
    • If you do not receive a confirmation of your license plate registration, it is your responsibility to contact VParking.ca immediately to verify the status of your registration.
    • If you fail to obtain confirmation and do not reach out to VParking.ca, and your vehicle is subsequently ticketed or towed because your plate was not registered or recognized, VParking.ca will not be responsible for any related fines, fees, towing charges, or other expenses.
    • By using our service, you accept that maintaining proof of registration (the confirmation) is your responsibility.
  • Indemnification:
    • You agree to indemnify and hold harmless VParking.ca, its owners, affiliates, officers, employees, and agents from and against any and all claims, losses, damages, liabilities, penalties, costs, or expenses (including reasonable legal fees) arising out of or relating to:
    • (a) your use or misuse of our services;
    • (b) any information you provide through VParking.ca (e.g., inaccurate license plate or contact information); or
    • (c) your violation of these Terms and Conditions or any applicable law or regulation.
    • This indemnification obligation means that if a third party (for example, a property owner, another user, or an authority) makes a claim against VParking.ca because of something you did (or failed to do), you will be responsible for any resulting harm or costs.
  • Modification and Termination of Services:
    • VParking.ca reserves the right to modify, suspend, or terminate our services (in whole or in part) at any time without prior notice.
    • We may also update these Terms and Conditions from time to time. Whenever we make changes to the terms, we will post the updated Terms on our website with a new effective date.
    • It is your responsibility to review the Terms periodically for any changes. Continued use of the services after updated Terms have been posted constitutes your acceptance of those changes.
    • We may additionally terminate or suspend your access to the services if you violate these Terms or for any other operational reason.
    • In the event of termination or suspension, any provisions of these Terms which by their nature should survive (such as liability limitations and indemnification) will remain in effect.
  • Intellectual Property:
    • All content and materials on the VParking.ca website — including text, graphics, logos, buttons, icons, images, software, and other intellectual property — are the property of VParking.ca or its licensors and are protected by copyright, trademark, and other applicable intellectual property laws.
    • You are granted a limited, revocable, non-exclusive, and non-transferable right to use the site and its content for the purpose of using our services.
    • You agree not to reproduce, distribute, modify, publicly display, create derivative works from, or exploit any portion of our site or services without our express written permission.
    • Any unauthorized use of the website or its content may violate intellectual property laws and these Terms and Conditions.
  • Privacy and Data Sharing:
    • Your privacy is important to us. By using our services, you agree that VParking.ca can collect, use, and disclose your personal information in accordance with our Privacy Policy (outlined below).
    • This includes the use of your information to manage parking registrations and the sharing of certain personal data (such as your name, phone number, email address, and license plate details) with third parties for specific purposes, as described here:
    • Service and Enforcement Partners: We may share relevant information with parking enforcement personnel, patrolling/towing companies, condominium boards, property managers, or similar entities as needed to administer parking rules and enforcement. For example, a towing company or patrol service may receive your license plate number to verify that your vehicle is registered and authorized to park in a given area.
    • Business Development Partners: With your consent, we may share your information for the development of tailored services or offers from third parties such as automotive services, car insurance providers, or similar companies. You will be given the option to opt in for such communications.
    • No Unapproved Sharing: We will not share your personal data with any third parties except as described above, or unless you explicitly authorize it.

  • Governing Law and Jurisdiction:
    • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.
    • By using VParking.ca, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the services will be brought exclusively in the courts of Alberta.
    • You consent to the personal jurisdiction of the courts in Alberta and waive any objections to such jurisdiction or venue.
    • If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed from the Terms, and the remaining provisions will continue in full effect.
    • These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and VParking.ca regarding your use of the services.

  • Residence or Property Details (if applicable): If your parking registration is tied to a specific property (for example, a condominium or apartment complex), we may collect details like your unit number or the property address, as needed to administer the parking program.
  • Usage Data: Technical information and usage data collected when you interact with our website, such as your IP address, browser type, device information, pages or screens you access, and the dates/times of your visits. We may use cookies or similar technologies to collect some of this data to help improve our services and website functionality.
How We Use Your Information

We use the personal information we collect for a variety of purposes related to operating, maintaining, and improving our services. These purposes include:

  • License Plate Registration and Parking Management: To register your vehicle's license plate in our system and manage your parking permissions (for instance, verifying that your vehicle is authorized to park in a particular location and for the allotted time).
  • Providing Confirmation and Support: To provide you with confirmation of your registration (such as sending confirmation emails or reference numbers) and to communicate with you about your account or use of the service. This includes sending important notifications (e.g., updates about parking policy changes, reminders of expiring registrations, or responses to inquiries you send us).
  • Service Improvement and Analytics: To monitor, analyze, and improve the usage and functionality of our website and services. For example, we may use usage data to troubleshoot performance issues, to understand user engagement, or to develop new features that enhance your experience.
  • Marketing and Promotional Communications: If you have given consent, to inform you about new services, special offers, or promotions offered by VParking.ca or our third-party partners. This might include emails or messages about parking-related services, vehicle maintenance offers, or other relevant products and services. (You will have the opportunity to opt out of such marketing communications if you change your mind, as described below.)

  • Opt-Out Option: You may opt out of sharing your data for these purposes at any time by emailing us at info@vparking.ca. If you choose to opt out, we will remove your personal data from future sharing lists, but please note this may limit some of the personalized services or offers you could receive.

Upon receiving a verified request to delete information, we will remove or anonymize the personal information we hold about you, unless retaining it is necessary for us to fulfill legal obligations or legitimate business purposes. Please note that if you ask us to delete information that is essential to providing the service (for example, your license plate registration), you may no longer be able to use that service. In addition, some data may be retained in backups or archival systems for a certain period until those systems are refreshed.
  • Opt-Out of Marketing Communications: If you have consented to receive marketing emails or messages from us or our third-party partners, you can opt out at any time. To opt out of VParking.ca newsletters or promotions, click the "unsubscribe" link in any email we send, or reply with a request to unsubscribe, or email us at info@vparking.ca stating that you do not wish to receive promotional communications. To opt out of communications from our third-party partners (after you have consented to our sharing your info with them), you may need to follow the opt-out instructions in their communications or privacy policy. Alternatively, you can contact us and we will assist in ensuring your information is no longer shared or used for those purposes going forward.
  • Opt-Out of Third-Party Data Sharing: Even if you agreed earlier to share information with our business partners for marketing or service offers, you can change your mind. You may withdraw your consent at any time by contacting us at info@vparking.ca and letting us know that you no longer want your personal information shared with third parties for marketing purposes. Once we process your request (please allow some time for processing), we will cease including your data in any future partner sharing initiatives. (This opt-out will not undo information already shared with partners, but those partners are obligated to honor any direct request you make to them as well.)

We will not discriminate against you for exercising any of these rights. For example, if you opt out of marketing communications, we will not downgrade your service; you will simply stop receiving promotional messages. Keep in mind that even if you opt out of marketing emails, we may still send you transactional or service-related communications (such as confirmation of your registration or important notices about your use of the service) as these are not promotional in nature.
